Terms and Conditions

7. Fitness for Purpose:

The Purchaser agrees that it does not rely on the skill or judgement of the Company in relation to the suitability of any goods or services for a particular purpose unless it has indicated that purpose in writing to the Company and the Company has acknowledged that the goods will be fit for that purpose.

8. Sales Tax:

Unless otherwise stated, quoted prices do not include sales tax. Should any sales tax or other tax, fee, levy or duty imposed by any competent authority be payable on any goods or services supplied by the Company, such tax, levy or duty will be to the Purchaser's account.

9. Goods and Services Tax:

All goods delivered, or services performed after 1 July 2000 will incur an additional charge for GST. The Company will supply a tax invoice in accordance with prescribed regulations and the Purchaser may if permitted by law claim the imputed tax credit as appropriate.

10. Purchasers Responsibility:

The Purchaser is to hold the goods as the Company's fiduciary agent and bailee. In so far as the Purchaser is empowered to resell his goods, he resells as principal in relation to any sub-Purchaser, and has no right to commit the Company to any contractual relationship or liability to any third party. As between the Company and the Purchaser, the Purchaser is to sell as fiduciary agent. The Purchaser is to keep the goods separate from his own and those of third parties, properly stored, protected and insured. The Purchaser undertakes to notify the Company promptly in the event of any change in the trading address and/or the ownership of the Purchaser and/or in the conversion of a sole trader/partnership entity into an incorporated Company. The Purchaser will indemnify the Company against any loss incurred by it due to any change of ownership of the Purchaser unless written advice of such change is received by the Company prior to the commencement of tooling and/or production and/or delivery of the goods.

11. Privacy:

The Purchaser agrees that The Company may use your personal information for it's legitimate functions including promotions. The company will not disclose your personal information except as required to perform our functions or if required to do so by any other Commonwealth, state or territory law.

12. Disputes:

In the event of any dispute between the parties arising out of supply of the goods or services by the Company to the Purchaser, either party may give written notice of the existence of such dispute to the other whereupon both parties shall attempt to resolve the dispute in good faith. The parties shall consider using Assisted Dispute Resolution procedures in any attempt to resolve the dispute. Failing resolution of the dispute, either party may refer the matter to arbitration or to a court of competent jurisdiction. The laws of New South Wales govern this agreement. Each party irrevocably submits to the non-exclusive jurisdiction of the Courts of New South Wales.

13. Claims:

 for discrepancies or shortages must be notified in writing within 7 days of delivery. Claims in regards to invoices must be made within 7 days of invoice date.

14. Warranty:

All new components excluding batteries are supplied with a 12-month warranty in regards to faulty materials and Workmanship from date of purchase, the purchaser is responsible for freight and associated cost of return of goods for assessment to the Company's Head Office. Should the problem not relate to faulty materials and workmanship a quotation will be provided for the repair or replacement of the goods. Goods repaired or replaced under warranty will be shipped ex factory at the company's expense items not covered by warranty will be shipped at the Purchases expense. For Warranty on AutoCITE enforcement products please refer to the AutoCITE Warranty & Maintenance Agreement. Please obtain a Return Authorisation Number from Duncan Solutions Customer Support Department (02) 9432 0500 or by E-mail support @ duncansolutions.com.au Proof of purchase will be required in the form of a Duncan Solutions Invoice or Delivery Docket before making any warranty claims/returns. No claims/returns will be processed without a valid RA number any goods returned without an RA will not be accepted. Any damaged/defective parts replaced under warranty must be returned to Duncan Solutions Sydney office within 14 days of a replacement being provided. Failure to do so will result in the replacement parts being invoiced at full value and no credit being processed.
